Medical Malpractice occurs when a doctor's action or inaction falls below the professional standards of "reasonably prudent" care. Malpractice is usually not intentional or malicious. It is simply care that is below standard. In trial, it is up to the jury to decide if the doctor's care was "reasonably prudent."




Florida doctors enjoy many special protections within the law to shield against malpractice lawsuits.

Attorneys in Florida don't accept malpractice claims lightly. Attorneys are required to certify that they have performed a reasonable investigation into a case, and state that they have good reason to make the claim. Later, if a judge determines that the lawyer had no basis to believe a claim exists, the judge may enter sanctions against the attorney.
